If you reside in Texas and you are pregnant with a disability, there are several provisions that will protect you as you deal with your disability.  First, if you need to take time off for your disability, you might be protected under the Family and Medical Leave Act, if you meet the requirements defined under the Act.  You might be eligible to take up to twelve weeks off for the care of a newborn or the birth of a child too.  You can also be eligible to take time off to care for a serious health issue during your pregnancy. Under the FMLA, you will be able to take time off without worrying about the loss of your job; however, this Act does not demand that Texas disability for pregnancy benefits get paid to you.

Your employer may have special disability programs in effect; you will need to speak with your employer to explore your options if you need to go out on disability while you are pregnant.  You might also have short-term disability coverage available to you through your existing health insurance if you have it.

If your disability is pregnancy related, it is not likely that you will be eligible for Supplemental Security Income, but if you expect the disability to last longer than five months, you can apply for Social Security Disability Insurance through the Social Security Administration.  Your disability will have to be long term, and completely disable you from your job in order for you to qualify.  Meanwhile, if your disability is not pregnancy related, but is related to an injury at work, you might be eligible to receive Worker’s Compensation benefits until you can return to work. 

You will want to have everything you need to prove your disability in the event that you have short-term disability coverage or you discover there is a disability program available where you work.  You need medical documentation indicating the nature of your disability and contact information for your physicians.  As an alternative to disability, you can also request vacation time or sick leave pay during your pregnancy if it is offered to you and there are no disability options open to you.
